Ministry Clarifies Strict Prohibition on Hiring Reserve Candidates for Different Positions

The Ministry of National Education has clarified its strict stance on employing reserve candidates in positions different from those for which they originally competed, thereby ending an ongoing debate regarding the employment of reserve candidates in ranks entirely different from those they passed the competition for. Minister of National Education Mohamed El-Saghir Saadaoui provided these clarifications in response to written question No. 10255 from MP Mir Mohamed. The Ministry of Relations with Parliament transmitted the official response via dispatch No. 517 on February 10, 2026, sent specifically by the Minister of Relations with Parliament.

Legal Basis for Prohibition

Reserve candidates for the rank of 'Education Supervisor' are strictly prohibited from being employed in the newly created rank of 'Specialized Educational Support Educator'. This clarification from the Ministry of National Education aligns with Executive Decree No. 25/54, dated January 21, 2025, which formally established the 'Specialized Educational Support Educator' position. Executive Decree No. 25/54 specifically pertains to the basic statute for employees belonging to the special ranks of national education. This decree outlines the framework for these particular roles within the educational system.

The Ministry further explained that the utilization of reserve lists, under the exceptional license, adhered to established legal controls. These controls are primarily outlined in Executive Decree No. 12-194, dated April 25, 2012. Executive Decree No. 12-194 specifies the procedures for organizing and conducting professional competitions, as well as exams and assessments, across public institutions and administrations, ensuring a standardized and transparent process for recruitment.

Previous Exceptional License Use

Minister Saadaoui had previously sent dispatch No. 428 on April 22, concerning the utilization of reserve lists for administrative ranks, indicating a broader consideration of such lists. In early September 2025, the Ministry requested an exceptional license from the Directorate General of Civil Service and Administrative Reform to use reserve lists from 2024 competitions. An exceptional license was subsequently obtained on October 21, 2025, specifically for using reserve lists for the 'Education Supervisor' rank. This license was explicitly intended to fill vacant positions within the 'Education Supervisor' rank during 2025, addressing specific staffing needs within the established framework.

Upon receiving the license, provincial education directorates commenced utilizing the reserve lists for the 'Education Supervisor' rank. This process also incorporated Instruction No. 01, dated February 20, 2013, from the Directorate General of Civil Service and Administrative Reform. Instruction No. 01 permits the exceptional use of reserve lists to fill vacant positions between competitions under specific circumstances, including instances of retirement, transfer, national service, dismissal, resignation, and death, providing a mechanism for continuity in staffing.

Reserve List Expiration Rules

The Ministry of National Education has affirmed that the practice of hiring reserve candidates for positions different from their original competition is legally impossible and cannot be implemented. The Ministry confirmed that employing reserve candidates from the 2024 'Education Supervisor' competition in 'Specialized Educational Support Educator' positions is strictly prohibited. This prohibition is due to the significant difference between the duties of the 'Education Supervisor' rank and the responsibilities of the 'Specialized Educational Support Educator' rank, a distinction reinforced by Executive Decree No. 25-54, dated January 21, 2025. Reserve candidates are appointed solely to the rank for which they successfully passed the competition, in accordance with applicable legal and regulatory texts, ensuring that qualifications align precisely with the designated role. Reserve lists automatically expire upon the opening of the competition or professional examination for the subsequent year, or at the latest, before the fiscal year concludes. The Ministry emphasized that this expiration rule is mandatory and cannot be waived by agreement, upholding the integrity and timeliness of the recruitment process.
